DEFINITIONS
• “Affiliates” mean (i) any Person which, directly or indirectly is Controlled by Ozow or Hollywoodbets, or Controls Ozow or Hollywoodbets; and (ii) directors, officers, employees, agents and representatives of Ozow or Hollywoodbets. “Control”, as used in the preceding sentence, means the possession, directly or indirectly, of the power to direct or cause the direction of the management and policies of a Person, whether through the ownership of voting securities, by contract or otherwise;
• “Competition” means the opportunity, during the Competition Period, for an Entrant to win the Prize for a single deposit on any Hollywoodbets Website Platform, such single deposit being completed using the Ozow Platform;
• “Competition Period” means each calendar day from 25 June 2020 at 00:01 to 5 July 2020 at 24:00;
• “EFT” means electronic funds transfer;
• “Ozow” means Ozow (Pty) Ltd (Registration no. 2013/214663/07);
• “Ozow API” means Ozow’s application programming interface, being the software and set of functions and procedures which interface with Hollywoodbets’ systems to facilitate access to the Ozow Platform;
• “Ozow Platform” means the set of functions and procedures developed by Ozow which facilitate the payment by an Entrant of a good or service on a Hollywoodbets Website Platform by means of EFT;
• “Hollywoodbets” means Hollywood Sportsbook Gauteng (Pty) Ltd (Registration no. 2008/011557/07);
• “Hollywoodbets Website Platform” means the South African website/s operated by Hollywoodbets as well as related Hollywoodbets mobi-sites and software applications, which for the avoidance of doubt, are https://www.hollywoodbets.net/, https://m.hollywoodbets.net/, https://new.hollywoodbets.net/ and https://mob.hollywoodbets.net/;
• “Person” means any natural person, firm, company, corporation, state or agency of a state, or any joint venture, partnership, association or incorporated or unincorporated body; and
• “Prize” means the prize that a Winner is eligible to win, being a R250 credit to their account held with Hollywoodbets. There will be a total of twenty (20) Winners, equating to a total Prize value of R5 000. This will be sponsored by Ozow.
RULES
1. The Competition is sponsored by Ozow and co-promoted by Ozow and Hollywoodbets. By entering the Competition, you agree to the rules of the Competition.
2. The entry of any natural persons into the Competition (the “Entrant”) and/or acceptance of a Prize by an Entrant in the event that a Prize is won (the “Winner”) constitutes binding acceptance of these terms and conditions on behalf of the Entrant and Winner.
3. The Entrants agree that participation in the Competition, and acceptance and/or use of a Prize, or any aspect thereof, is at their own risk.
4. Twenty (20) Winners will be eligible to receive one (1) Prize during the Competition Period. The Winners will be chosen on 6 July 2020 and notified of their winnings within three (3) working days.
5. To enter the Competition, an Entrant should –
5.1 Make a minimum deposit of One-Hundred Rand (R100) on any of the Hollywoodbets Website Platforms by using the Ozow Platform during the Competition Period; and
5.2 An Entrant is allowed to complete as many deposits in accordance with clause 5.1 above during the Competition Period as the Entrant wishes to, and each of these completed deposits amounting to R100 or more shall constitute an entry into the Competition.
6. It is the responsibility of all Entrants to ensure that their entry is received by Ozow prior to the end of the Competition Period. Any entries that are not received during the Competition Period will not be eligible to participate, regardless of the reason. Ozow and/or Hollywoodbets will not be responsible for any entries which are not received by Ozow, whether timeously or at all, regardless of the cause thereof.
7. On 6 July 2020, the preliminary Winners will be determined at random by a computer-generated programme operated by Ozow in terms of which thirty (30) transaction IDs will be selected (“draw”). The determination of the draw made by Ozow and Hollywoodbets concerned will be final and no related correspondence will be entered into. Only the first twenty (20) transaction IDs will qualify as Winners unless any of these are forfeited, in which case the next transaction ID will qualify.
8. If a Winner declines their Prize, a new Winner will be chosen by Ozow and Hollywoodbets, according to these rules.
9. The Competition is not open to –
9.1 natural persons under the age of 18 years;
9.2 natural persons that do not have a registered account with Hollywoodbets;
9.3 directors, members, shareholders, agents, consultants or employees of Ozow or Hollywoodbets;
9.4 the spouse, life partner, business partner or associate, or the natural or adopted parent, child, or sibling, of any of the Persons specified in 9.1 above; or
9.5 the suppliers of any goods or services in respect of the Competition.
10. An Entrant may not win a Prize if it is unlawful for Ozow to provide a Prize to an Entrant. In the event that an Entrant does win a Prize, and it is unlawful for such Entrant to win a Prize, the Entrant concerned will forfeit the Prize.
11. There are no entry fees to participate in this Competition.
12. The data costs, or any other costs, incurred by an Entrant in purchasing goods or services on any Hollywoodbets Website Platform in the ordinary course outside of the Competition Period will apply during the Competition Period.
13. Hollywoodbets will attempt to make contact with each Winner at least three (3) times, but if Hollywoodbets is unable to contact any Winner within three (3) working days after the lucky draw, such Winner will forfeit his/her prize, and Hollywoodbets and Ozow reserve the right to redraw such prize. If such Winner agrees to accept the Prize subject to these terms and conditions, he/she will be a Winner of a Prize in the Competition.
14. The logistics involved for the Prize will be made within thirty (30) calendar days of the announcement of the Winners, by Ozow and Hollywoodbets (acting together), or such other time period that is communicated to the Winners by Ozow and/or Hollywoodbets.
15. The Prize may not be deferred, changed or exchanged for any other item.
16. Ozow will provide Hollywoodbets with the randomly selected transaction IDs from the draw. Hollywoodbets will then retrieve each Winner’s contact details associated with the transaction ID in order to inform the individual of their winnings, and obtain their consent to be contacted by Ozow. If consent in obtained, Hollywoodbets will then provide the contact details of each Winner to Ozow so that Ozow may congratulate the Winner on their winnings. If any of the Winners do not consent to the provision of their contact details being made available to Ozow by Hollywoodbets, Ozow will select another Winner(s) in accordance with these rules.
17. By entering the Competition, the Entrants agree that Ozow and its Affiliates (including Hollywoodbets) may contact the Entrants via email and through social media platforms to deliver marketing communications regarding their products and promotional activities, provided that the Entrants are given the opportunity to opt-out of receiving marketing communication at any time via the appropriate opt-out mechanisms provided by Hollywoodbets for such purpose.
18. Ozow may invite each Winner to be present when the Winners are announced, to participate in any marketing activities of Ozow, to appear in person in the electronic media and/or the print media, and/or to endorse, promote or advertise any of the goods sold or services rendered by Ozow, for which no fee, royalty or other compensation will be payable. The Winners may decline such an invitation.
19. Ozow reserves the right to vary, postpone, suspend, or cancel the Competition and any Prizes, or any aspect thereof, without notice at any time, and for any reason which Ozow deems necessary. In the event of such variation, postponement, suspension or cancellation, Ozow agrees to waive any rights, interests and expectations that any Entrants or Winners may have in terms of the Competition and acknowledges that no Entrant or Winner will have any recourse against Ozow, Hollywoodbets or any of their respective Affiliates.
20. Ozow may require the Winners to provide Ozow and Hollywoodbets with additional information and documentation in order to process, confirm and facilitate each Winner’s acceptance and delivery of their Prize. Hollywoodbets may facilitate the gathering of such information with Ozow. If any Winner refuses to provide Ozow with the requested information or documentation, such Winner will forfeit their Prize.
21. If any Entrant fails to comply with any of these terms and conditions, then, without prejudice to any other remedy which Ozow or Hollywoodbets may have, –
21.1 Such Entrant will be automatically disqualified, and such Entrant will forfeit their Prize (in the event that such Entrant has already won a Prize);
21.2 An Entrant and/or Winner will pay Ozow for any loss or damage incurred by Ozow directly or indirectly as a result of (or, if applicable, a partner’s or friends’) non-compliance, including all legal costs (including attorney and own client costs) which Ozow may incur in taking any steps pursuant to an Entrant and/or Winner’s (or partner’s or friends’) non-compliance; and
21.3 The parties indemnify and hold each other harmless against any claim by any Person, (whether direct, indirect, incidental, punitive or consequential) of any nature, whether arising from negligence or any other cause, relating to any death, injury, loss and/or damage which may be suffered howsoever arising in relation to the indemnifying party’s failure to comply herewith.
22. Ozow and the judges’ decision on any matter concerning the Competition and/or arising out of these terms and conditions is final and binding on all Entrants and Winners.
23. Ozow, Hollywoodbets and of their respective Affiliates will not be responsible, and disclaim all liability, for any loss, liability, injury, expense or damage (whether direct, indirect, incidental, punitive or consequential) of any nature, whether arising from negligence or any other cause, which is suffered by any Entrant’s participation in the Competition; the acceptance and/or use by an Entrant, or such Entrant’s partner or friends (if applicable), of any Prize; or by any action taken by Ozow or Hollywoodbets in accordance with these terms and conditions.
24. Without limitation, Ozow, Hollywoodbets and their respective Affiliates are not responsible for, and are in no way liable in relation to, any problems or technical malfunction of any telephone network or lines, computer on-line systems, servers, or providers, computer hardware or software failure or malfunction, traffic congestion (whether physical, or on the internet, telephone lines or at any service provider, website or other device or medium), or any combination thereof, or any other technical or other problems experienced by an Entrant when entering the Competition.
25. Ozow, Hollywoodbets and their Affiliates are not responsible for any injury or damage suffered by an Entrant’s, or any other Person’s, computer, mobile telephone or other device used by an Entrant to enter into, or obtain any materials related to, the Competition.
26. Ozow and Hollywoodbets do not make any representations or give any warranties, whether expressly or implied, as to a Prize, and in particular, but without limitation, makes no representations and gives no warranty that –
26.1 An Entrant’s entry or participation in the Competition will necessarily result in such Entrant winning a Prize; or
26.2 A Prize, or any aspect thereof, will meet an Entrant’s or, if applicable, an Entrant’s partner’s, requirements, preferences, standards or expectation.
27. All Entrants, and in the event of an Entrant’s death, an Entrant’s family, dependants, heirs, assignees or any other beneficiaries of an Entrant’s estate, indemnify and hold Ozow, Hollywoodbets and of their respective Affiliates, harmless against any claim by an Entrant, or an Entrant’s partner or friends (if applicable), (whether direct, indirect, incidental, punitive or consequential) of any nature, whether arising from negligence or any other cause, relating to any injury, loss, liability, expense and/or damage which an Entrant or its partner or friends (if applicable) may suffer, howsoever arising, in relation to such Entrant’s entry into the Competition and/or acceptance and/or use by such Entrant of a Prize.
28. These terms and conditions will be construed, interpreted and enforced in accordance with the laws of the Republic of South Africa.
29. The Competition is regulated by the Consumer Protection Act, 68 of 2008 (“CPA”), and it is not intended that any provision of these terms and conditions contravenes any provision of the CPA. Therefore, all provisions of these terms and conditions must be treated as being qualified by the CPA, if necessary, to ensure that the provisions of the CPA are complied with.
30. If any dispute arises in relation to the Competition and its rules, the decision of Ozow and Hollywoodbets shall be final and no correspondence shall be entered into
